These Terms apply to all sales contracts concluded through the online store respawnshop.com and, where applicable, to direct purchases made at the company’s business premises.

I. INTRODUCTORY PROVISIONS

I.a Acceptance of the Terms

Respawn d.o.o., as the Seller, makes these Terms available to users and instructs them to carefully read them before using the Website and/or purchasing products. By accessing the Website, registering a user account, submitting an order and/or purchasing products, users are deemed to be familiar with these Terms, to fully understand them and to accept them in their entirety.

If the user does not agree with these Terms, they are advised not to use the Website or conclude any purchase.

These Terms form an integral part of each individual sales contract. For all matters not regulated by these Terms, the applicable laws of the Republic of Croatia and relevant regulations of the European Union shall apply, in particular: the Consumer Protection Act, the Civil Obligations Act, the Electronic Commerce Act and the Trade Act.

Users are also referred to the Privacy Policy and Cookie Policy published on the Website.

I.b Definitions

For the purposes of these Terms:

  • User means any natural or legal person who accesses the Website and/or uses the services of the online store.

  • Visitor means a user who browses the Website without registration.

  • Customer means a user who orders products via the Website and/or purchases products from the Seller.

  • Consumer means a natural person who enters into a legal transaction outside their trade, business, craft or professional activity.

  • Seller / Company means Respawn d.o.o.

  • Website means respawnshop.com.

  • Means of distance communication include all means suitable for concluding distance contracts (internet, e-mail, telephone, etc.).

  • Distance contract means a contract concluded between the trader and the consumer exclusively through means of distance communication.

I.c Minors

Contracts on behalf of minors may only be concluded by their legal representatives. The Seller bears no responsibility for actions taken contrary to this provision.

II. PRICES AND SALES CONDITIONS

II.a Prices

All prices displayed on the Website are expressed in euros (EUR) and include VAT, unless explicitly stated otherwise. The Seller strives to ensure price accuracy and timeliness; however, in the event of an obvious pricing error, the Seller reserves the right to inform the Customer and allow confirmation of the order at the correct price or to cancel the order.

II.b Product descriptions and images

The Seller makes reasonable efforts to provide accurate product information. Product images may be illustrative and may not fully correspond to the actual appearance of the product.

II.c Payment methods

The Customer may pay for ordered products using the payment methods available during checkout, including:
a) card payments (credit/debit cards)
b) bank transfer (payment to IBAN)
c) other payment methods displayed during the checkout process, if available

III. SECURITY OF CREDIT CARD PAYMENTS

The confidentiality of your data is protected and secured by using the latest TLS encryption. Online payment pages are secured using the Secure Socket Layer (SSL) protocol with 128-bit data encryption. SSL encryption is a data encryption process designed to prevent unauthorized access during data transmission.

This enables secure data transfer and prevents unauthorized access during communication between the user’s computer and the WebPay service, and vice versa.
The WebPay service and financial institutions exchange data via a virtual private network (VPN), which is protected against unauthorized access.

The Monri Payment Gateway is certified according to the PCI DSS Level 1 security standard prescribed by Visa and Mastercard rules.
The Seller does not store credit card numbers, and such information is not accessible to unauthorized persons.

Security program logos (ID Check, Visa Secure) may be displayed on the payment security information page and on the payment page.

IV. DELIVERY AND DELIVERY TIME

IV.a Delivery

Delivery is carried out via courier services and/or other delivery methods displayed during the checkout process. Delivery times depend on product availability, delivery location and the selected delivery option and are displayed before order confirmation.

IV.b Inspection upon delivery

Customers are advised to inspect the shipment packaging upon delivery. In case of visible damage, it is recommended to refuse acceptance of the shipment or prepare a damage report with the courier service.

V. PRODUCT RESERVATION

Placing a product in the shopping cart does not constitute a reservation. A product is considered ordered only after the Customer completes the order and receives an order confirmation (if applicable).

VI. COMPLAINTS AND CONSUMER CLAIMS

Consumers have the right to submit a written complaint in accordance with applicable regulations. Complaints may be submitted:

The Seller shall acknowledge receipt of the complaint without delay and provide a response within the time limit prescribed by the Consumer Protection Act.

VII. LIABILITY FOR MATERIAL DEFECTS AND WARRANTY

The Seller is liable for material defects in accordance with the Civil Obligations Act and special provisions applicable to consumer contracts.

If a manufacturer’s warranty is provided for a product, the warranty terms are specified in the product’s warranty documentation. The Customer is required to keep the receipt and, if issued, the warranty certificate in order to exercise warranty rights.

VIII. RIGHT OF UNILATERAL TERMINATION (CONSUMERS)

Consumers have the right, without stating reasons, to unilaterally terminate a distance contract within 14 days from the day the goods are received, in accordance with the Consumer Protection Act, except in cases prescribed by law.

Termination procedure:
The Consumer must submit a termination statement to [email protected] or by post to: Respawn d.o.o., Trg Hrvatskih Branitelja 4, 47000 Karlovac.

Refund:
The refund will be issued after the goods have been returned or after proof of return has been provided, whichever occurs first.

Return costs:
Direct return costs are borne by the Consumer, unless otherwise stated.

Diminished value:
The Consumer is responsible for any diminished value of the goods resulting from handling, except where handling was necessary to determine the nature, characteristics and functioning of the goods.

IX. OUT-OF-COURT DISPUTE RESOLUTION AND ODR

In the event of a dispute, the parties shall attempt to resolve it amicably. Consumers may use the EU Online Dispute Resolution (ODR) platform and other alternative dispute resolution mechanisms in accordance with applicable regulations.

X. INTELLECTUAL PROPERTY AND WEBSITE USE

All content on the Website (texts, images, graphics, logos, databases, software) is protected by intellectual property rights. Unauthorized use, copying, distribution or modification of content without prior written consent of the Seller or rights holder is prohibited.

Users undertake not to use the Website in a manner that could cause damage, system overload, unauthorized access or infringement of third-party rights.

XI. LIMITATION OF LIABILITY

The Website and its content are provided on an “as is” and “as available” basis. The Seller shall not be liable for damages resulting from temporary unavailability of the Website, technical errors or actions of third parties, except where liability cannot be excluded under mandatory law.

XII. PERSONAL DATA PROTECTION AND COOKIES

Personal data processing is carried out in accordance with the GDPR and applicable national regulations. Details are set out in the Privacy Policy and Cookie Policy published on the Website.

XIII. FINAL PROVISIONS

The Seller reserves the right to amend these Terms at any time. Amendments take effect upon publication on the Website. Contracts concluded prior to publication of amendments remain subject to the Terms applicable at the time of contract conclusion, unless mandatory law provides otherwise.
